The Position:

The Senior Counsel, Regulatory Law will be a member of the Regulatory Law Group and report to Associate General Counsel, Regulatory Law and Compliance Officer, Life Sciences.

The successful candidate will be a core member of BD’s legal team helping drive the Company’s mission, protecting the Company, and serving as a trusted advisor and strategic leader within the department and the Company. S/he will provide tactical support and will serve as a strategic legal partner to BD’s Environmental, Health and Safety (EH&S), Regulatory Affairs, and Global Trade organizations.

This is a unique opportunity for an individual to serve as a trusted advisor and commercially astute business partner who will collaborate effectively across the Company to assist the Company in meeting business objectives while ensuring regulatory compliance and mitigating risk. The successful candidate will be a “hands-on” attorney who is able to operate autonomously, yet effectively collaborate across a matrixed organization.

This position has direct client contact at the business unit leadership level and the corporate senior leadership level. The successful candidate will have the opportunity to make an immediate contribution to BD’s continuing growth and success. The person sought for this role will be a proven, high potential candidate with strong intellectual and technical skills and successor qualities and attributes.

Roles & Responsibilities: The responsibilities of the position will include:

  • Provide expert advice and legal counsel to clients throughout the organization on a variety of regulatory law matters, with a focus on environmental, health and safety laws including those relating to hazardous site remediation, clean water, air pollution, catastrophe prevention, and risk management. Primary clients include EH&S, Regulatory Affairs, and Quality.

  • Provide day to day legal advice and oversight to a variety of constituents including management, customers, and governmental officials on a range of EH&S matters.

  • Understand and be able to translate into “plain English” the legal ramifications of varied legal and regulatory risks.

  • Support cross-functional teams, including Sustainability and EH&S, with the development of policies, procedures, and training programs to ensure that FDA regulations and other regulatory best practices are reflected in the Company’s business activities.

  • Ability to contemplate the legal implications of new innovations and collaborate with the business to develop regulatory strategies for new technologies.

  • Develop strong relationships throughout all functional areas, departments, and divisions to foster an advisory or collaborative approach to proactive compliance.

  • Expert on EPA, DEP, and OSHA requirements; support for other regulatory legal issues including medical device and pharmaceutical regulatory law and global trade.

  • Knowledge of US conflict minerals rules and EU REACH preferred.

  • Commercially oriented, understanding the nuances of complicated regulatory issues and able to think creatively to solve problems and mitigate risk while supporting business objectives.

  • Superior writing skills with an ability to present nuanced, complicated, and content rich issues.

  • Ability to draft and implement key corporate policies and procedures to empower and enable associates to achieve business objectives in a compliant manner.

  • Keeps up to date on all current and pending environmental, health and safety legislation and regulations.

Required Qualifications & Skills :

Experienced practitioner, with 5 to 7 years relevant law firm, government (e.g., EPA, DEP) or in-house experience. Must have significant experience in advising on environmental, health and safety matters.

  • The successful candidate will hold a law degree with strong academic credentials from an accredited law school and will have obtained an undergraduate degree from a college or university of recognized standing.

  • S/he will be licensed in good standing to practice law in at least one state and one federal jurisdiction within the United States without any instances of suspension, revocation, censure or other adverse events in any jurisdiction, whether or not the candidate is currently admitted to practice in that jurisdiction.

  • Active member of a state bar.

  • 5+ years’ experience implementing procedures/policies in a highly regulated, complex sales and manufacturing environment.

  • Experience in environmental litigation preferred.

  • Experience with healthcare laws, including medical device regulations, is desirable. Interest in and willingness to learn medical device and pharmaceutical regulation is required.

  • Superior writing skills with an ability to present nuanced, complicated, and content rich issues clearly and succinctly.

  • Ability to work effectively on teams and interface with external/internal parties, including administrative agencies (e.g., EPA, FDA, CMS, FTC).

  • Strong interpersonal and relationship skills and ability to influence diverse stakeholders, navigate controversial situations, and change traditional ways of doing business.

  • Excellent oral and written communication skills, with experience communicating with individuals at various levels and functions within an organization, including senior management.

  • Solid analytical and conceptual skills, critical thinking, and problem-solving skills.

  • Proven project management experience, exceptional organizational skills, and a keen attention to detail.

  • Effective strength in working collaboratively across many functions, countries, and cultures to drive results on complex projects.

  • Demonstrated ability to be proactive, exercise independent judgment, and manage multiple projects simultaneously.

  • Strong work ethic and ability to produce high-quality work under significant deadline pressures.

  • Unquestionable integrity and ethics and ability to remain firm with these principles under pressure.

  • Ability to travel approximately 25% of the time.
